Terms and conditions of use

Purpose and acceptance

Registering an account or using the Service implies full and unreserved acceptance of these terms. If the user does not agree with them, they must not use the Service.

The Service will operate under the main domain gestperitia.com; the domains gestperitia.es and gestperitia.cat will redirect to it.

Description of the service

Gest Peritia is a web application for the complete management of the practice of court-appointed experts in any field of expertise.

The Service is a hosted application, accessed from the browser. The working data (case files, the expert's clients, court writings, reports and accounts) is stored on servers managed by the provider and located in the European Union, and is kept separate by organisation: each user has access only to their own.

The main features of the Service are as follows:

  • Management of expert-witness case files.
  • Deadline tracking and reminders.
  • Production of court writings from templates.
  • Drafting of expert reports.
  • Fee management.

User account

An account is required in order to use the Service. Access works without a password: it is requested by giving an email address, to which an access link and a single-use code are sent; the account is created automatically on first access. If sign-in through external providers is enabled (OAuth: Google or GitHub), only the email address and the name are received from the chosen provider.

The user warrants that the details provided on registration are accurate and undertakes to keep them up to date.

Access credentials are personal and non-transferable. The user is responsible for keeping them safe and for all activity carried out from their account, and must report any unauthorised use without delay to info@tarracoapplab.com.

The Service is aimed at professionals: the user declares that they are of legal age and that they use Gest Peritia in the exercise of their professional activity as an expert.

The processing of the personal data linked to the account is described in the Privacy policy; to exercise the rights granted by the GDPR you may write to privacidad@tarracoapplab.com.

Proper use of the service

The user undertakes to use the Service diligently, in accordance with the law, with these terms and with the requirements of good faith.

Failure to comply with these obligations may lead to the suspension or cancellation of the account, without prejudice to any legal action that may be appropriate. The following conduct is prohibited in particular:

  • Using the Service for unlawful purposes or purposes contrary to the applicable rules.
  • Reverse engineering, decompiling or disassembling the application for unlawful purposes.
  • Reselling, sublicensing or commercially exploiting the Service without the prior written agreement of the owner.
  • Attempting to breach the security measures of the Service or to access third-party accounts.

Gest Peritia does not provide legal advice

Gest Peritia is a tool for organising and drafting documents. It does not provide legal advice or services reserved to lawyers or court agents, and using it does not replace the professional judgement of the expert or the advice of a lawyer.

The owner does not warrant the procedural validity, the suitability or the sufficiency of the documents produced with the Service. The expert must review and adapt every writing and every report before filing or delivering it, and is responsible for keeping up to date with the rules applicable to their work.

Templates and content

The templates for court writings and the other documentary content included in the Service are a guiding working basis. They are not official models and do not guarantee that they will be accepted by courts, tribunals or other institutions.

It is for the user to check that each document complies with the procedure, the jurisdiction and the rules applicable at the relevant time.

Backups in the local version

The working data (case files, clients, court writings, reports and accounts) belongs to the user, who remains its owner at all times. The provider merely hosts and processes it in order to provide the Service, following the user's instructions.

For this reason, the owner cannot recover or restore local data in the event of breakdown, loss or theft of the machine, or of accidental deletion. Regular backups of the database are strongly recommended, kept on a secure medium.

The user is solely responsible for preserving and protecting the information stored on their machine.

Intellectual property

The Gest Peritia software, its source code, design, trade marks, logos, templates and other content of the Service are owned by Tarraco App Lab or by its licensors, and are protected by intellectual and industrial property law.

Registering an account grants the user a personal, non-exclusive and non-transferable licence of use, limited to the purpose of the Service.

The documents, reports and data that the user produces or enters with the tool are their exclusive property.

Changes to the service and to these terms

The owner may introduce improvements, functional changes or new versions of the Service, including the future cloud version; once it exists, these terms and the associated policies will be updated.

The owner may also amend these terms for legal, technical or operational reasons. Material amendments will be communicated through the application itself with reasonable notice; using the Service after they take effect will imply acceptance of them.

Governing law and jurisdiction

These terms are governed by Spanish law.

For any dispute arising from access to or use of the Service, the parties submit to the courts and tribunals of the city of Tarragona (Spain), unless a different mandatory venue applies under the rules in force.

Governing version

This text is an English translation provided for convenience. In the event of any discrepancy between this version and the Spanish one, the Spanish version prevails, as it is the version drafted under the Spanish law that governs these terms.
