Purpose of the site and of the application

Gest Peritia is a web application for the complete management of the practice of court-appointed experts in any field of expertise. It allows you to organise case files, keep track of deadlines, produce court writings from templates, draft expert reports and manage fees.

Gest Peritia is a tool for organising and drafting documents. It does not provide legal advice and does not replace the professional judgement of the expert, of a lawyer or of any other legal professional.

Gest Peritia is a hosted application: it is used from the browser, with nothing to install, and the working data (case files, clients, court writings, reports and accounts) is stored on servers managed by the provider and located in the European Union. Each user has access only to the data of their own organisation.

Terms of use

Accessing and using Gest Peritia confers the status of user and implies acceptance of this legal notice. The user undertakes to use the application diligently, in accordance with the law, good faith and public order.

The following is prohibited in particular:

The user is responsible for keeping their access credentials confidential and for the accuracy of the details provided on registration.

Using the application for unlawful purposes or purposes contrary to this legal notice, or in a way that may harm the rights or interests of third parties.
Attempting to gain unauthorised access to other users' accounts or to restricted areas of the systems.
Introducing or spreading viruses or other elements that may damage or alter the operation of the application or of third-party systems.
Impersonating another user or a third party when registering or using the service.

Intellectual and industrial property

The Gest Peritia software, its design, its code, the “Gest Peritia” trade mark and name, and the templates for court writings and reports included in the application, are owned by Tarraco App Lab or by its legitimate licensors and are protected by intellectual and industrial property law.

Use of the application does not imply any assignment of these rights. The reproduction, distribution, transformation or public communication of the software is not permitted, nor is its decompilation or reverse engineering, beyond what the law or the express consent of the owner authorises.

The content the user creates with the application (case files, court writings, expert reports and other working documents) belongs to the user. Tarraco App Lab acquires no rights over it; moreover, in the local version that content is not even transmitted to Tarraco App Lab.

Disclaimer

Gest Peritia is a tool that supports the organisation and drafting of documents. It does not constitute legal advice, and its templates and the texts it produces do not guarantee procedural suitability or legal correctness of the result in any particular case.

The user, as the responsible professional, must review every document before signing it or filing it with courts, tribunals or any other recipient. Responsibility for the final content of the documents lies solely with the user.

The local version of the application is provided “as is”. Since it runs and stores the data on the user's own machine, Tarraco App Lab cannot guarantee continued availability, the preservation of the data or the absence of incidents arising from the user's own environment (machine, operating system, backups). Regular backups of the data are recommended.

None of the above excludes or limits the liability of Tarraco App Lab in those cases in which, under the applicable law, it cannot be excluded or limited.

Third-party links

The application may contain links to third-party sites, such as official resources (for example, the Spanish Data Protection Agency) or the documentation of the bodies cited in the court writings. Tarraco App Lab is not responsible for the content or the privacy policies of those sites, access to and use of which are subject to their own terms.

Data protection

The processing of users' personal data is governed by the Privacy policy and the Cookie policy of Gest Peritia, which form an integral part of this legal notice.

Amendments

Tarraco App Lab may amend this legal notice to adapt it to legal, technical or operational changes, or to new versions of the application (in particular, the future cloud version). The version in force will always be the one published on this page.

Governing law and jurisdiction

This legal notice is governed by Spanish law.

For the resolution of any dispute arising from access to or use of the application, the parties submit to the courts and tribunals of the city of Tarragona, except in those cases in which the law establishes a different mandatory venue; in particular, where the user is a consumer, the courts of their place of residence will have jurisdiction.

Governing version

This text is an English translation provided for convenience. In the event of any discrepancy between this version and the Spanish one, the Spanish version prevails, as it is the version drafted under Spanish law, which governs this legal notice.
